Nevada Personal Injury Laws That Affect Your Case

Nevada injury victims need to understand how state laws affect the outcome and value of a personal injury claim. Some important laws to be aware of include:

Statute of Limitations

Nevada gives most injury victims two years from the date of their accident to file a personal injury lawsuit in court.

4.  Within 2 years:

(e) Except as otherwise provided in NRS 11.215 or 11.217, an action to recover damages for injuries to a person or for the death of a person caused by the wrongful act or neglect of another. The provisions of this paragraph relating to an action to recover damages for injuries to a person apply only to causes of action which accrue after March 20, 1951.

Missing this deadline usually means you lose your right to recover compensation, but there are exceptions.

For cases involving minors or delayed discovery of injuries, the deadline can be extended. However, for cases against government entities, different or shorter deadlines might apply. This makes it it essential to consult a lawyer as soon as possible.

Comparative Negligence

Nevada follows modified comparative negligence, which can impact the amount of damages you receive. If you are determined to be somewhat at fault for your own injuries, you can still recover compensation as long as you are not more than 50% responsible. However, your compensation will be reduced by your own percentage of fault.

1.  In any action to recover damages for death or injury to persons or for injury to property in which comparative negligence is asserted as a defense, the comparative negligence of the plaintiff or the plaintiff’s decedent does not bar a recovery if that negligence was not greater than the negligence or gross negligence of the parties to the action against whom recovery is sought.

2.  In those cases, the judge shall instruct the jury that:

(a) The plaintiff may not recover if the plaintiff’s comparative negligence or that of the plaintiff’s decedent is greater than the negligence of the defendant or the combined negligence of multiple defendants.

(b) If the jury determines the plaintiff is entitled to recover, it shall return:

(1) By general verdict the total amount of damages the plaintiff would be entitled to recover without regard to the plaintiff’s comparative negligence; and

(2) A special verdict indicating the percentage of negligence attributable to each party remaining in the action.

Insurance Requirements

Drivers in Nevada are required to carry minimum amounts of auto liability coverage, which sets the baseline for injury recovery in many car accident cases. As of the most recent law, the minimums are $25,000 for bodily injury per person, $50,000 for bodily injury per accident, and $20,000 for property damage (“25/50/20”). If the responsible party has only the minimum amount of liability and your damages exceed that, you may have to file a lawsuit against the person directly to try to recover more compensation.
